BookR Community Standards and Prohibited Items Policy

1. PURPOSE

BookR seeks to maintain a safe, lawful, and trustworthy marketplace environment.

Users must comply with this Policy when creating Listings, participating in Transactions, communicating through the Platform, and utilizing Services.

2. GENERAL STANDARDS

Users shall:

(a) act honestly and lawfully; (b) provide accurate information; (c) respect other Users; (d) comply with Applicable Law; and (e) utilize the Platform only for legitimate purposes.

3. PROHIBITED ITEMS

The following categories of Items may not be listed, rented, advertised, or otherwise made available through the Platform.

Section 8 sets out additional conditions that apply to Items that are permitted but carry category-specific risk. An Item that is not prohibited by this Section may still be removed if the conditions in Section 8 are not met.

3.1 Weapons.

Including:

(a) firearms; (b) ammunition; (c) explosives; (d) destructive devices; (e) firearm components; and (f) prohibited weapons.

This prohibition extends to airsoft guns, paintball markers, crossbows, bows, and archery equipment, and to replica or deactivated firearms, regardless of whether the item is regulated as a firearm under Applicable Law.

3.2 Illegal Substances.

Including:

(a) illegal drugs; (b) controlled substances unlawfully possessed; (c) drug paraphernalia prohibited by law; and (d) other unlawful substances.

3.3 Stolen or Fraudulent Property.

Including:

(a) stolen Items; (b) counterfeit goods; (c) unlawfully obtained property; and (d) Items offered without authority.

3.4 Hazardous Materials.

Including:

(a) toxic chemicals; (b) hazardous waste; (c) explosive materials; (d) dangerous biological materials; and (e) other Items presenting unreasonable safety risks.

Compressed gas cylinders, propane tanks, and fuel containers may not be listed or transferred with fuel in them. An Item that uses fuel or compressed gas must be handed over empty, and the Renter is responsible for obtaining fuel separately.

3.5 Illegal or Restricted Property.

Including any Item whose rental would violate Applicable Law.

3.6 Alcohol, Tobacco, Cannabis, and Vaping Products.

Alcohol, tobacco products, cannabis and cannabis products, nicotine products, and vaping devices and their consumables may not be listed, rented, included with an Item, or supplied to a Renter through the Platform.

Equipment associated with the service of alcohol — including kegerators, draft systems, bar equipment, and glassware — may be listed, but must be supplied empty and without any alcohol. An Owner who supplies alcohol with such equipment is selling or furnishing alcohol, which is outside the scope of this Platform and may require a licence under Applicable Law.

3.7 Recalled Products.

An Item that is subject to an outstanding safety recall, or that has been the subject of a recall that has not been remedied, may not be listed.

Owners are responsible for checking whether an Item they list is subject to a recall before listing it and for removing a Listing promptly if a recall is issued afterward. Recall information for consumer products is published by the U.S. Consumer Product Safety Commission.

This applies with particular force to children's products, where recalls are common — see §8.5.

3.8 Items Requiring a Licence, Permit, Certification, or Registration.

An Item may not be listed where its rental, possession, or operation requires a licence, permit, certification, registration, endorsement, or inspection that the Owner does not hold.

Without limitation, this includes:

(a) equipment regulated as medical devices, including mobility, respiratory, monitoring, and therapeutic devices; (b) commercial food-service equipment where a permit or inspection is required; (c) amusement devices, inflatables, and rides where a state or local inspection, registration, or operator certification is required; (d) pyrotechnic, flame-effect, laser, and stage-effect equipment; (e) radio-transmitting equipment requiring a licence; and (f) any equipment whose operation requires an operator certification the Owner cannot verify the Renter holds.

Terms of Service §5.2(d) separately requires an Owner to represent that the Owner holds all permissions, licences, registrations, and approvals required to rent an Item.

3.9 Age-Restricted Items.

An Item that may lawfully be possessed or operated only by a person above a stated age may not be listed unless the Listing states that age requirement clearly.

All Users must be at least eighteen (18) years of age (Terms of Service §4.1(a)). An Owner may not rent an Item to a person the Owner knows or reasonably believes to be under any higher age required for that Item, and may not permit a Renter to take possession on behalf of a person below that age.

3.10 Items That Cannot Be Cleaned or Sanitized Between Rentals.

An Item that comes into direct contact with skin, hair, the mouth, or bodily fluids and that cannot be cleaned or sanitized between rentals may not be listed.

Without limitation, this includes cosmetics and applicators, undergarments, swimwear worn next to the skin, mouthpieces and reeds supplied for wind instruments, and used personal-hygiene items.

Costumes, helmets, wetsuits, and similar Items may be listed, subject to §8.6.

3.11 Motor Vehicles and Aircraft.

Motor vehicles, motorcycles, mopeds, motorized scooters, trailers requiring registration, watercraft requiring registration or an operator's licence, and aircraft may not be listed.

Jet skis, personal watercraft, motorboats, and any other motorized or engine-powered watercraft may not be listed, regardless of registration status. This exclusion is categorical, not conditioned on whether a specific unit happens to require state registration — BookR does not support motorized watercraft as a matter of product scope, not only as a matter of registration law.

BookR does not currently support any vehicle category, and the additional insurance, registration, and liability regime that applies to peer-to-peer vehicle sharing is outside the scope of these policies.

Non-motorized and non-registrable equipment — bicycles, kayaks, canoes, paddleboards, hand carts, and similar — is not prohibited by this Section and is addressed in §8.

3.12 Animals.

Live animals may not be listed, rented, transferred, or offered through the Platform under any circumstances.

4. PROHIBITED CONDUCT

Users shall not:

(a) commit fraud; (b) submit false information; (c) manipulate reviews; (d) abuse the Protection Program; (e) harass Users; (f) circumvent Platform Fees; or (g) engage in unlawful conduct.

5. REPORTING VIOLATIONS

BookR does not currently offer an in-Platform mechanism for reporting a suspected violation of this Policy. Until such a mechanism is available, suspected violations may be reported using the contact information in Section 10.

A report should identify, where possible, the Listing, Booking, or User involved, the date of the conduct, and any communications or other information relevant to the report.

BookR reserves the right to investigate any report, and may decline to investigate any report, in its sole and reasonable discretion. Submission of a report does not obligate BookR to take any particular action or to communicate an outcome.

6. ENFORCEMENT

BookR may:

(a) remove Listings; (b) remove Content; (c) suspend Accounts; (d) terminate Accounts; (e) deny Protection Program eligibility; (f) cancel Transactions; or (g) take any other action reasonably necessary to protect the Platform.

BookR does not review Listings before they are published, does not monitor communications between Users for compliance with this Policy, and assumes no obligation to detect an Item or a conduct that violates it. The exercise or non-exercise of any right described in this Section shall not create any duty or obligation owed by BookR to any User.

Compliance with this Policy is the Owner's responsibility in the first instance.

7. POLICY MODIFICATIONS

BookR reserves the right to update, expand, modify, or supplement prohibited categories at any time.

The examples contained herein are illustrative and not exhaustive.

8. CONDITIONS APPLICABLE TO PARTICULAR CATEGORIES

The Items in this Section are not prohibited. They carry category-specific risk, and the conditions below apply in addition to the general obligations in Terms of Service §5.3 (accuracy) and §5.4 (condition).

8.1 Watersports.

This category is limited to non-motorized, human- or wind-powered equipment — kayaks, canoes, paddleboards, rafts, tow-behinds, and similar. Motorized watercraft of any kind are excluded under §3.11 and may not be listed in this or any other category.

An Owner listing a kayak, canoe, paddleboard, raft, tow-behind, or similar Item shall state in the Listing whether a U.S. Coast Guard–approved personal flotation device (PFD) is included and, if so, in what sizes.

Most states require a wearable PFD to be on board for each person on most watercraft, and impose additional requirements for children; requirements vary by state and by body of water. Owners are not required to supply PFDs, but must state clearly whether they do. Renters are responsible for confirming that a PFD of the correct size and rating is available for every person who will use the Item, and for complying with Applicable Law regarding its use in the state where the rental occurs.

An Owner shall not list a PFD, helmet, or other life-safety equipment that is expired, damaged, visibly degraded, or that has been subject to a significant impact.

8.2 Tools and Power Equipment.

An Owner listing a power tool, generator, compressor, ladder, lift, or similar Item shall:

(a) include any guard, shield, blade cover, or other safety device supplied with the Item by the manufacturer, and shall not list an Item from which such a device has been removed; (b) state in the Listing whether the manufacturer's manual or operating instructions are provided; and (c) disclose any known defect, modification, or repair affecting safe operation.

Renters shall operate such Items in accordance with the manufacturer's instructions, and shall not operate an Item while impaired (Terms of Service §6.6(c)).

Fuel-powered equipment is subject to §3.4.

8.3 Party and Event Equipment.

An Owner listing an inflatable, tent, canopy, staging, seating, heating, or similar Item shall disclose set-up requirements, weight or occupancy limits, and anchoring or ballast requirements where the manufacturer specifies them.

Inflatables and amusement devices subject to state or local inspection or registration are prohibited under §3.8 unless the Owner holds the required registration. This does not restrict private, non-commercial rental for a Renter's own event — the inspection and registration requirements most states and municipalities impose on inflatable and amusement equipment apply to public or commercial operation, not to occasional peer-to-peer use for a private gathering.

An Owner listing a generator or fuel-powered heater for use at an event shall state that the Item is intended for outdoor or well-ventilated use only, and shall disclose any carbon-monoxide safety feature (automatic shutoff, built-in detector, or similar) the Item includes. Renters are responsible for never operating fuel-powered equipment in an enclosed tent, structure, or other unventilated space.

A large tent, canopy, or staging structure may require a local fire-code or event permit depending on its size and the number of people it will accommodate; Renters are responsible for confirming and obtaining any permit required by the municipality where the event takes place.

Equipment associated with alcohol service is subject to §3.6.

8.4 Sports and Outdoor Equipment.

An Owner listing a helmet or other protective equipment shall not list an Item that is expired, damaged, or that has sustained a significant impact.

An Owner listing climbing, rappelling, harness, rope, or other life-safety equipment shall disclose the Item's age and usage history. Renters should independently assess the suitability of any life-safety equipment before use.

An Owner listing a trampoline or above-ground or inflatable pool shall disclose the manufacturer's weight limit, age recommendation, and any enclosure, netting, or fencing included with the Item. Renters are responsible for providing constant adult supervision when children are using a trampoline or pool, and for complying with any local ordinance requiring a barrier or fence around a pool.

8.5 Kids and Baby.

This is the highest-risk category on the Platform and the one where recalls are most frequent.

An Owner listing a car seat, crib, playpen, bassinet, stroller, carrier, high chair, gate, or similar Item shall:

(a) confirm before listing that the Item is not subject to an outstanding recall (§3.7); (b) state the manufacturer, model, and — where the manufacturer prints one — the expiration date; and (c) disclose whether all original components, straps, and instructions are included.

A child restraint or car seat that has been involved in a motor vehicle crash may not be listed, whether or not damage is visible.

A crib or playpen with a drop-side rail may not be listed, regardless of recall status. Drop-side cribs were banned from manufacture and sale by 16 C.F.R. §§ 1219–1220 (2011); this is a design prohibition, not a recall-status check, so a pre-2011 unit with no open recall is still prohibited if it has a drop-side rail.

Renters are responsible for confirming that any Item in this category is appropriate for the child's age, height, and weight, and for installing and using it in accordance with the manufacturer's instructions.

8.6 Costumes and Wearables.

Costumes, uniforms, wetsuits, helmets, and similar wearable Items may be listed, subject to §3.10.

An Owner shall state in the Listing how the Item is cleaned between rentals.

An Item that replicates the uniform, badge, or insignia of a law enforcement officer, firefighter, emergency medical responder, or member of the armed forces may not be listed where its rental or use would violate Applicable Law.

8.7 Electronics.

An Owner listing a drone or other unmanned aircraft shall state in the Listing whether the aircraft requires registration and shall not list an aircraft that is required to be registered and is not. Renters are responsible for operating in accordance with Applicable Law, including any registration, remote-identification, and airspace requirements.

An Owner listing a camera, recording device, or similar Item shall not list an Item configured for concealed or covert recording.

An Owner listing an Item containing a lithium battery shall disclose any known damage, swelling, or fault in that battery, and shall not list an Item with a damaged battery.

8.8 Home.

An Owner listing a space heater, pressure washer, carpet cleaner, or similar Item shall disclose any known electrical or mechanical fault and shall include the manufacturer's operating instructions where available.

Items subject to §3.7 (recalled products) and §3.8 (licensed or regulated equipment) are excluded from this category regardless of how they are described.

8.9 Music.

Wind instruments may be listed, but mouthpieces, reeds, and other components that contact the mouth are subject to §3.10 and must not be supplied used. An Owner shall state in the Listing whether a mouthpiece is included.

9. RELATIONSHIP TO OTHER POLICIES

This Policy should be read together with:

(a) Terms of Service, in particular §5.2, §5.3, §5.4, §5.8, §6.5, §6.6, and §8.11; (b) Rental Agreement; (c) Accessibility and Non-Discrimination Policy; (d) Copyright and DMCA Policy; (e) Insurance Disclosure; and (f) other applicable Platform policies published by BookR.

Terms used in this Policy and not defined here have the meanings given to them in the Terms of Service.

In the event of a conflict between this Policy and the Terms of Service, the Terms of Service shall govern.
