BookR Privacy Policy

1. INTRODUCTION

1.1 Purpose of this Privacy Policy.

BookrApp, LLC ("BookR," "Company," "we," "our," or "us") respects the privacy of its users and is committed to protecting personal information collected through the BookR platform, including our website, mobile applications, and related services (collectively, the "Platform").

This Privacy Policy describes how BookR collects, uses, stores, shares, and protects information obtained from users of the Platform.

By accessing or using the Platform, creating an Account, completing identity verification procedures, submitting information to BookR, or otherwise utilizing the Services, you acknowledge that you have read and understand the practices described in this Privacy Policy.

1.2 Scope of this Privacy Policy.

This Privacy Policy applies to information collected by BookR in connection with:

(a) creation and management of user Accounts; (b) Listings, Bookings, and Transactions; (c) identity verification procedures; (d) customer support interactions; (e) communications through the Platform; (f) operation of the Protection Program; (g) fraud prevention and security measures; and (h) use of the Platform generally.

This Privacy Policy does not apply to information collected by third parties whose services may be integrated with or accessible through the Platform.

1.3 Related Policies.

This Privacy Policy should be read together with BookR's:

(a) Terms of Service; (b) Biometric Information Policy; (c) Protection Program Policy; (d) Rental Agreement; and (e) any additional policies incorporated by reference into the Platform.

Where applicable, separate policies may provide additional disclosures regarding specific categories of information or Platform features.

1.4 Changes to this Privacy Policy.

BookR reserves the right to modify, amend, or update this Privacy Policy at any time.

Where required by Applicable Law, BookR will provide notice of material changes through the Platform, email communications, or other reasonable means.

Continued use of the Platform following the effective date of a revised Privacy Policy constitutes acceptance of the revised Privacy Policy.


2. INFORMATION WE COLLECT

2.1 Information You Provide Directly.

BookR collects information that Users voluntarily provide when creating Accounts, utilizing Services, communicating with BookR, completing Transactions, or otherwise interacting with the Platform.

Such information may include:

(a) full legal name; (b) email address; (c) telephone number; (d) mailing or residential address; (e) date of birth; (f) profile information; (g) account credentials; (h) communication preferences; and (i) any other information submitted through the Platform.

2.2 Identity Verification Information.

To promote trust, safety, fraud prevention, and compliance with applicable legal obligations, BookR may collect information used to verify a User's identity.

Such information may include:

(a) government-issued identification documents; (b) driver's licenses; (c) passports; (d) state identification cards; (e) photographs submitted for verification purposes; (f) selfie images; (g) verification results; and (h) information generated during identity verification procedures.

BookR may utilize third-party service providers to assist with identity verification and fraud prevention.

Collection, use, retention, storage, and processing of biometric information, biometric identifiers, or facial geometry data shall be governed by BookR's Biometric Information Policy, where applicable.

2.3 Payment Information.

To facilitate Transactions and administer the Platform, BookR may collect certain payment-related information.

Such information may include:

(a) billing information; (b) payment method details; (c) payment verification information; (d) transaction history; (e) payout information; and (f) payment processor records.

Payment processing services are generally provided by third-party Payment Processors. BookR does not typically store complete payment card numbers and instead relies upon secure third-party providers for payment processing functions.

2.4 Transaction Information.

BookR collects information relating to Listings, Bookings, Rentals, Claims, Reviews, Ratings, Communications, and other activities conducted through the Platform.

Such information may include:

(a) Listing details; (b) Item descriptions; (c) rental dates; (d) rental prices; (e) booking history; (f) claim submissions; (g) reimbursement records; (h) reviews and ratings; and (i) communications between Users.

This information helps BookR facilitate Transactions, administer claims, investigate disputes, and improve Platform functionality.

2.5 Device and Technical Information.

When Users access or utilize the Platform, BookR may automatically collect certain technical and usage information.

Such information may include:

(a) Internet Protocol (IP) address; (b) browser type and version; (c) operating system; (d) device identifiers; (e) application version information; (f) referral URLs; (g) access times and dates; (h) clickstream data; (i) crash reports; and (j) other diagnostic and technical information.

BookR uses this information to operate, secure, maintain, analyze, and improve the Platform.

2.6 Location Information.

BookR may collect location-related information to facilitate Listings, Transactions, fraud prevention efforts, and Platform functionality.

Location information may include:

(a) approximate geographic location derived from IP addresses; (b) location information voluntarily provided by Users; (c) listing locations; (d) pickup and return locations; (e) GPS information where authorized by the User; and (f) other location-related information reasonably necessary to facilitate Transactions.

Users may be able to adjust certain location-sharing permissions through their device settings; however, certain Platform features may not function properly if location services are disabled.

2.7 Communications Information.

BookR may collect information contained within communications conducted through the Platform.

Such information may include:

(a) messages exchanged between Users; (b) communications with customer support; (c) inquiries regarding Listings or Transactions; (d) claims-related communications; (e) dispute-resolution communications; and (f) other communications submitted through the Platform.

BookR may utilize such information to administer Transactions, investigate claims, enforce policies, prevent fraud, and improve Platform safety.

2.8 Information from Third Parties.

BookR may receive information relating to Users from third parties.

Such third parties may include:

(a) payment processors; (b) identity verification providers; (c) fraud prevention providers; (d) analytics providers; (e) service providers; (f) business partners; and (g) publicly available sources.

BookR may combine information obtained from third parties with information collected directly from Users.


3. HOW WE USE INFORMATION

3.1 General Use of Information.

BookR uses information collected through the Platform to operate, maintain, improve, protect, and administer the Services.

The specific uses of information depend upon the nature of the User's interaction with the Platform.

3.2 To Provide and Operate the Platform.

BookR uses information to:

(a) create and maintain Accounts; (b) facilitate Listings and Transactions; (c) process Bookings; (d) administer payments and payouts; (e) manage communications between Users; and (f) provide Platform functionality.

3.3 To Verify Identity.

BookR uses information to verify the identity of Users and promote trust and safety within the Platform.

Verification activities may include:

(a) document authentication; (b) identity verification procedures; (c) fraud prevention measures; (d) account security procedures; and (e) compliance-related reviews.

Identity verification activities may involve third-party verification providers.

3.4 To Prevent Fraud and Promote Security.

BookR uses information to detect, prevent, investigate, and respond to:

(a) fraudulent activity; (b) unauthorized access; (c) account abuse; (d) payment disputes; (e) suspicious transactions; (f) security incidents; and (g) violations of Platform policies.

BookR may utilize automated tools, manual review procedures, and third-party services in connection with fraud prevention efforts.

3.5 To Process Payments and Transactions.

BookR uses information to:

(a) process payments; (b) facilitate payouts; (c) administer Fees; (d) verify payment methods; (e) recover amounts owed under the Terms of Service; and (f) administer claims and reimbursements.

3.6 To Administer the Protection Program and Claims Process.

BookR may use information to:

(a) investigate claims; (b) evaluate eligibility for reimbursement; (c) review supporting documentation; (d) assess damage, theft, or loss allegations; (e) resolve disputes; and (f) enforce rights arising under Platform policies.

3.7 To Communicate with Users.

BookR uses information to communicate regarding:

(a) Transactions; (b) verification procedures; (c) claims; (d) customer support matters; (e) policy updates; (f) account notifications; (g) security alerts; and (h) operational communications.

Such communications may be delivered through email, text message, in-app notifications, Platform notices, or other communication channels.

3.8 To Improve the Platform.

BookR uses information to better understand how Users interact with the Platform and to improve Services.

Such uses may include:

(a) performance analysis; (b) troubleshooting; (c) feature development; (d) usability improvements; (e) analytics; and (f) research and development activities.

Information may be aggregated, anonymized, or de-identified for certain purposes.

3.9 To Comply with Legal Obligations.

BookR may use information to comply with:

(a) Applicable Law; (b) court orders; (c) subpoenas; (d) regulatory requests; (e) law enforcement requests; and (f) other legal obligations.

BookR may also use information to establish, exercise, or defend legal rights and claims.

3.10 To Enforce Terms and Policies.

BookR may use information to enforce:

(a) Terms of Service; (b) Protection Program requirements; (c) Community Standards; (d) verification requirements; (e) payment obligations; and (f) other Platform policies.

Such uses may include investigations, enforcement actions, account restrictions, claim reviews, recovery efforts, and dispute resolution procedures.

3.11 Corporate Transactions.

BookR may use and transfer information in connection with:

(a) mergers; (b) acquisitions; (c) financing transactions; (d) asset sales; (e) reorganizations; and (f) other corporate events.

Any successor entity may continue to use information in accordance with this Privacy Policy and Applicable Law.


4. HOW WE SHARE INFORMATION

4.1 General Disclosure Practices.

BookR does not sell personal information in exchange for monetary compensation.

BookR may disclose information as described in this Privacy Policy to operate the Platform, facilitate Transactions, promote safety, comply with legal obligations, protect rights, and support legitimate business operations.

The categories of information disclosed and the recipients of such information may vary depending upon the Services utilized by a User.

4.2 Sharing Between Users.

Because the Platform facilitates Transactions between independent Users, certain information may be shared with other Users.

Information shared between Users may include:

(a) first name and last initial; (b) profile information; (c) ratings and reviews; (d) Listing information; (e) rental information; (f) pickup and return information; (g) communications relating to Transactions; and (h) other information reasonably necessary to facilitate a Transaction.

BookR does not publicly display government-issued identification documents, payment information, or biometric information.

4.3 Service Providers.

BookR may disclose information to third-party service providers that assist in operating the Platform.

Such providers may perform services including:

(a) payment processing; (b) identity verification; (c) fraud prevention; (d) cloud hosting; (e) database management; (f) customer support; (g) communications delivery; (h) analytics; (i) security monitoring; and (j) Platform infrastructure management.

As of the date of this Policy, BookR's service providers include Supabase (database hosting and infrastructure), Stripe (payment processing and identity verification for Owner payouts), Vercel (application hosting), and Resend (transactional email delivery). BookR may add, remove, or change service providers from time to time; this list reflects current practice and is not a contractual commitment to use any particular provider.

Such providers are generally authorized to access information only as necessary to perform services on BookR's behalf.

4.4 Payment Processors.

BookR may disclose payment-related information to third-party Payment Processors for purposes including:

(a) payment processing; (b) payment verification; (c) fraud prevention; (d) chargeback management; (e) payouts; and (f) collection of amounts owed under Platform policies.

Payment processing activities are generally governed by the privacy policies and terms of the applicable Payment Processor.

4.5 Identity Verification and Fraud Prevention Providers.

BookR may disclose information to identity verification, fraud prevention, risk assessment, and security service providers.

Information disclosed may include:

(a) identification documents; (b) photographs; (c) verification information; (d) device information; (e) account information; and (f) other information reasonably necessary to verify identity and reduce fraud.

Such disclosures may occur before, during, or after Transactions.

4.6 Claims Administration and Dispute Resolution.

BookR may disclose information where reasonably necessary to investigate, evaluate, administer, or resolve claims, disputes, reimbursement requests, payment disputes, or Protection Program matters.

Information may be shared with:

(a) Owners; (b) Renters; (c) service providers; (d) professional advisors; (e) law enforcement agencies; and (f) other parties reasonably involved in the applicable matter.

4.7 Legal Compliance and Protection of Rights.

BookR may disclose information where reasonably necessary to:

(a) comply with Applicable Law; (b) respond to legal process; (c) comply with court orders; (d) respond to subpoenas; (e) respond to regulatory inquiries; (f) protect the rights, property, or safety of Users; (g) protect the rights, property, or safety of BookR; or (h) investigate unlawful conduct.

BookR may disclose information where it reasonably believes such disclosure is required or appropriate under the circumstances.

4.8 Business Transfers and Corporate Transactions.

BookR may disclose, transfer, assign, or otherwise make available information in connection with:

(a) mergers; (b) acquisitions; (c) reorganizations; (d) financing transactions; (e) bankruptcy proceedings; (f) asset sales; or (g) other corporate transactions.

Information transferred in connection with such transactions shall remain subject to applicable privacy commitments and legal obligations.

4.9 Professional Advisors.

BookR may disclose information to attorneys, accountants, auditors, consultants, insurers, financial advisors, and other professional advisors where reasonably necessary to obtain professional services, manage risk, enforce legal rights, or comply with legal obligations.

4.10 Aggregated and De-Identified Information.

BookR may utilize, disclose, publish, distribute, license, or otherwise make available aggregated, anonymized, or de-identified information for lawful business purposes.

Such information is not intended to identify any individual User and may be used for analytics, research, operational improvements, industry reporting, marketing, or other legitimate purposes.

4.11 No Disclosure of Biometric Information Except as Authorized.

BookR does not disclose biometric identifiers or biometric information except as permitted by Applicable Law, authorized by the applicable User, necessary to provide verification services, or otherwise described in the applicable Biometric Information Policy.

The collection, retention, storage, disclosure, and destruction of biometric information shall be governed by BookR's Biometric Information Policy.


5. IDENTITY VERIFICATION AND BIOMETRIC INFORMATION

5.1 Identity Verification Services.

To promote trust, safety, fraud prevention, compliance, and security, BookR may require Users to complete identity verification procedures before accessing certain features of the Platform.

Identity verification procedures may include:

(a) submission of government-issued identification documents; (b) submission of photographs or selfie images; (c) payment method verification; (d) address verification; (e) fraud screening procedures; and (f) other verification measures reasonably deemed necessary by BookR.

BookR may utilize third-party verification providers to facilitate identity verification procedures.

5.2 Verification Procedures.

Identity verification procedures may occur:

(a) during Account creation; (b) before participating in Transactions; (c) before receiving payouts; (d) during claim investigations; (e) following suspicious activity; or (f) at any other time reasonably necessary to protect the Platform or Users.

BookR reserves the right to require re-verification of Users from time to time.

5.3 Facial Matching and Biometric Technologies.

Where permitted by Applicable Law, BookR and its service providers may utilize facial matching technologies, biometric comparison tools, fraud detection technologies, and related systems to verify identity, prevent fraud, and protect Platform security.

Such technologies may compare photographs, identification documents, selfies, or similar information submitted by Users.

Participation in certain verification procedures may require processing of biometric identifiers, biometric information, facial geometry data, or similar information.

5.4 Fraud Prevention and Security Monitoring.

BookR may use information collected during verification procedures to:

(a) authenticate Users; (b) prevent fraudulent activity; (c) identify unauthorized access; (d) detect account abuse; (e) investigate suspicious transactions; (f) support claims investigations; and (g) protect the integrity of the Platform.

Verification information may be combined with other information available to BookR for security and fraud prevention purposes.

5.5 Biometric Information Policy.

The collection, storage, use, retention, disclosure, and destruction of biometric identifiers and biometric information are governed by BookR's Biometric Information Policy.

Users should review the Biometric Information Policy for additional disclosures regarding:

(a) biometric information collected; (b) purposes of collection; (c) retention schedules; (d) destruction procedures; (e) disclosure practices; and (f) applicable user rights.

5.6 Consent Requirements.

Where required by Applicable Law, BookR shall obtain any required consent before collecting, processing, or utilizing biometric identifiers or biometric information.

Users may decline to provide biometric information; however, certain Platform features, verification procedures, Transactions, payout functions, or Services may be unavailable if required verification procedures cannot be completed.

5.7 Limitations of Verification.

Identity verification procedures are intended to reduce risk but cannot eliminate all risks associated with peer-to-peer transactions.

Completion of identity verification procedures does not constitute a guarantee regarding:

(a) a User's identity; (b) trustworthiness; (c) financial condition; (d) legal compliance; (e) future conduct; or (f) suitability for any Transaction.

Users remain responsible for exercising independent judgment when participating in Transactions.


6. DATA RETENTION

6.1 Retention of Information.

BookR retains information for as long as reasonably necessary to operate the Platform, provide Services, fulfill legal obligations, resolve disputes, enforce agreements, protect Platform security, and support legitimate business operations.

Retention periods may vary depending upon the type of information involved and the purposes for which it was collected.

6.2 Account Information.

BookR may retain Account information during the life of an Account and, as a proposed default period, for up to twenty-four (24) months following Account closure, to:

(a) maintain records; (b) investigate fraud; (c) comply with legal obligations; (d) enforce Platform policies; and (e) protect BookR and Users.

6.3 Transaction Records.

BookR may retain information relating to Listings, Bookings, Rentals, Claims, Reviews, Ratings, Payments, and other Transaction-related activities for periods reasonably necessary to support business operations, legal compliance, dispute resolution, and recordkeeping obligations. As a proposed default, financial and payment-related records (including information supporting tax filings such as Form 1099-K) are retained for at least seven (7) years following the Transaction, consistent with common recordkeeping practice for financial records; non-financial Transaction information such as Listing and Review content may be retained for a shorter or longer period as reasonably necessary.

6.4 Verification Information.

Verification information may be retained for fraud prevention, security, compliance, auditing, dispute resolution, and operational purposes.

Retention and destruction of biometric information shall be governed by the applicable Biometric Information Policy.

6.5 Legal and Regulatory Requirements.

Certain information may be retained for longer periods where necessary to:

(a) comply with Applicable Law; (b) satisfy regulatory obligations; (c) respond to legal process; (d) resolve disputes; (e) establish legal claims; (f) defend legal claims; or (g) enforce contractual rights.

6.6 Account Closure and Deletion Requests.

Users may request closure of their Accounts or deletion of certain information, subject to Applicable Law and legitimate business requirements.

BookR may retain information following Account closure where reasonably necessary to:

(a) complete Transactions; (b) investigate fraud; (c) comply with legal obligations; (d) enforce agreements; (e) protect Platform security; or (f) preserve evidence relating to disputes or claims.

6.7 De-Identified Information.

BookR may retain aggregated, anonymized, or de-identified information indefinitely for lawful business purposes, provided such information is not intended to identify individual Users.


7. DATA SECURITY

7.1 Security Measures.

BookR maintains administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, destruction, misuse, and loss.

Such safeguards may include:

(a) access controls; (b) encryption technologies; (c) authentication procedures; (d) monitoring systems; (e) vendor management practices; and (f) other security measures reasonably appropriate to the nature of the information maintained.

7.2 Third-Party Service Providers.

BookR utilizes third-party service providers to support Platform operations, including payment processing, cloud hosting, communications, identity verification, and security services.

While BookR seeks to work with reputable providers, BookR does not control the independent security practices of third-party organizations.

7.3 User Responsibilities.

Users are responsible for maintaining the confidentiality of Account credentials and for taking reasonable precautions to protect their devices, passwords, and personal information.

Users should promptly notify BookR of any suspected unauthorized access, security incident, or compromise involving their Account.

7.4 Security Limitations.

No method of electronic transmission, storage, or security system is completely secure.

Accordingly, BookR cannot guarantee that information will never be accessed, disclosed, altered, destroyed, or misused by unauthorized parties.

Users acknowledge and accept the inherent security risks associated with electronic communications, internet-based services, and digital storage systems.

7.5 Incident Response.

BookR may investigate suspected security incidents and take actions reasonably necessary to protect Users, the Platform, and BookR's systems.

Where required by Applicable Law, BookR may provide notifications relating to certain security incidents or data breaches.

7.6 International Transmission and Storage.

Information collected through the Platform may be stored, processed, transmitted, or accessed by service providers and systems located in various jurisdictions.

By utilizing the Platform, Users acknowledge that information may be transferred and processed as necessary to provide Services and operate the Platform.


8. COOKIES AND TRACKING TECHNOLOGIES

8.1 Cookies.

BookR may utilize cookies, pixels, local storage technologies, software development kits (SDKs), and similar technologies to operate, secure, maintain, and improve the Platform.

Cookies may be used for purposes including:

(a) account authentication; (b) session management; (c) fraud prevention; (d) security monitoring; (e) performance optimization; and (f) Platform functionality.

8.2 Analytics Technologies.

BookR may utilize analytics tools and service providers to better understand how Users interact with the Platform.

Analytics information may include:

(a) pages viewed; (b) features utilized; (c) interaction patterns; (d) referral information; (e) device information; and (f) usage statistics.

Such information may be aggregated or de-identified for reporting and operational purposes.

8.3 Session Management.

BookR may utilize cookies and similar technologies to maintain login sessions, remember preferences, improve user experience, and facilitate Platform functionality.

Disabling certain cookies may limit functionality or prevent access to portions of the Platform.

8.4 Browser and Device Controls.

Most browsers and devices provide settings allowing Users to manage cookies and certain tracking technologies.

Users may choose to block, delete, or limit certain technologies; however, portions of the Platform may not function properly if such technologies are disabled.

8.5 Future Advertising Technologies.

BookR may utilize advertising, marketing, remarketing, audience measurement, or promotional technologies in the future.

Should such technologies be implemented, BookR may update this Privacy Policy and provide any disclosures required by Applicable Law.


9. USER RIGHTS AND CHOICES

9.1 Access Requests.

Subject to Applicable Law, Users may request information regarding certain personal information maintained by BookR.

BookR may require reasonable verification of identity before responding to such requests.

9.2 Correction Requests.

Users may request correction of inaccurate personal information maintained by BookR.

BookR may request documentation reasonably necessary to verify the requested correction.

9.3 Deletion Requests.

Subject to Applicable Law and legitimate business needs, Users may request deletion of certain personal information maintained by BookR.

BookR may decline deletion requests where retention is necessary to:

(a) complete Transactions; (b) comply with legal obligations; (c) investigate fraud; (d) enforce agreements; (e) protect rights and safety; or (f) resolve disputes.

9.4 Verification Requirements.

To protect privacy and security, BookR may require Users to verify their identity before processing requests relating to personal information.

Requests that cannot be reasonably verified may be denied.

9.5 Legal Exceptions.

Certain rights described in this Privacy Policy may be limited by Applicable Law, legal obligations, regulatory requirements, contractual obligations, or legitimate business interests.

BookR reserves all rights available under Applicable Law regarding retention, disclosure, and use of information.

9.6 Communication Preferences.

Users may update communication preferences through their Account settings where available.

Certain communications relating to Transactions, security, legal compliance, claims administration, and Platform operations may continue to be delivered regardless of marketing communication preferences.


10. CHILDREN'S PRIVACY

10.1 Age Restrictions.

The Platform is intended solely for individuals who are at least eighteen (18) years of age and possess the legal capacity to enter into binding agreements.

BookR does not knowingly permit minors to create Accounts, participate in Transactions, or utilize the Platform.

10.2 Information Collected from Minors.

BookR does not knowingly collect personal information from individuals under eighteen (18) years of age.

If BookR becomes aware that information relating to a minor has been collected in violation of this Policy, BookR may take steps to delete such information and terminate any associated Account.


11. THIRD-PARTY SERVICES

11.1 Third-Party Providers.

The Platform may utilize services provided by third parties, including providers of payment processing, identity verification, cloud hosting, analytics, communications, fraud prevention, and security services.

Such providers operate under their own terms, policies, and practices.

11.2 Payment Processors.

Payment-related activities are generally administered by third-party Payment Processors.

Users should review the privacy policies and terms of applicable Payment Processors to understand how such providers collect, use, and protect information.

11.3 Verification Providers.

BookR may utilize third-party identity verification, fraud prevention, and risk assessment providers.

Such providers may independently process information submitted in connection with verification procedures.

11.4 External Links and Services.

The Platform may contain links to third-party websites, services, applications, or resources.

BookR is not responsible for the privacy practices, content, security, or operations of third-party services.

Users access third-party services at their own risk.

12.1 Illinois Residents.

Illinois residents may be entitled to additional rights and disclosures relating to biometric information, identity verification procedures, and privacy practices.

Information relating to biometric identifiers and biometric information is addressed in BookR's Biometric Information Policy.

BookR may provide additional disclosures and rights applicable to residents of specific states, including California, Colorado, Connecticut, Virginia, Utah, and other jurisdictions as required by Applicable Law.

Such disclosures may be provided through updates to this Privacy Policy or separate supplemental notices.

12.3 Reservation of Rights.

BookR reserves the right to modify, supplement, expand, or revise state-specific disclosures as privacy laws evolve.
